International Child Support: Is It Possible to Collect When the Parent Lives Abroad?

“Distance does not extinguish the obligation. But collecting from someone on the other side of the world requires a very specific path.”

One of the greatest fears of those left with custody of children after a separation is this:

"What if the other parent moves abroad and stops paying child support?"

The legal answer is more encouraging than most people expect:

Yes, it is possible to collect child support from someone living abroad. But the path requires specialized technical knowledge.

📜 What Legal Framework Supports This?

Brazil is a signatory to two fundamental international instruments:

ConventionCountries Covered
New York Convention on Child Maintenance (1956)60+ countries
Hague Convention on International Recovery of Child Support (2007)USA, European Union, and others

This means there is an international obligation of cooperation for child support collection between signatory countries — including the United States, Portugal, Italy, Germany, France, and dozens of others.

🗂️ How Does It Work in Practice?

📋 Step 1: Brazilian court order You need to have (or obtain) a Brazilian court order establishing child support.

🌍 Step 2: Recognition abroad The Brazilian order needs to be recognized in the country where the obligor lives.

⚖️ Step 3: Local enforcement Authorities in the foreign country are engaged to enforce collection — wage garnishment, account freezing, local passport restriction.

🔒 Step 4: Parallel measures in Brazil Brazilian passport restriction, credit bureau registration (SPC/Serasa), and other pressure measures applicable when the obligor returns to Brazil.

⚠️ What If There Is No Treaty With That Country?

There are still alternatives — such as direct action in the obligor's country of residence, or negotiation through consular mediation. More complex, but not impossible.

The essential point is not to accept the situation passively.
